1. General provisions
The following conditions of use are a constituent part of all services provided in association with the use of kermi.de, kermi.com and all subdomains owned by Kermi GmbH.
Ancillary agreement, amendments and supplements must be made in writing to be effective. This also applies to waiving the requirement for written form. If there should be an ineffective clause in these conditions, all the others remain valid. The ineffective clause must be replaced by an effective clause which come closest to meeting the economic purpose of the respective wording.

4. Access authorisation
The user logs on to the Kermi partner area with their complete and correct information. The responsibility for protection (secrecy) of the passwords made available to the customer to access the Internet service provided is solely held by the customer. The user is not authorised to pass the access data (name and password) on to third parties outside of the registered company without written permission from Kermi. In the event of misuse. Kermi reserves the right to take legal action. The user undertakes to immediately change the password or to notify Kermi if they suspect that unauthorised third parties know the password.
5. Obligations of the user
The user is obliged to only use the online access appropriately. They will in particular not misuse access made available and will comply with the accepted data security principles for ensuring data protection. They will immediately notify Kermi about any misuse as soon as they are aware of it.The user indemnifies Kermi from all disadvantages incurred as a result of the user’s own contractual infringement or as a results of a claim by a third party. They will bear the end device costs and the telecommunications expenses.

With its judgement dated May 12, 1998 – 312 O 85/98 – “Liability for Links”, the Regional Court Hamburg decided that if you provide a link, you take on co-responsibility for the content of the linked page. This can only be prevented by expressly distancing yourself from these contents. On the Kermi web pages, there are links to other pages on the Internet. For all links on this page and the following pages, Kermi GmbH has no influence over their design and the content of the linked pages. For this reason we expressly distance ourselves from all content on linked pages on our platform including all subpages. This declaration applies to all links on our homepage and for all content on the pages which links or banners lead to. 7. Place of jurisdiction
The place of jurisdiction is our company headquarters, providing the customer is also a businessman within the meaning of the German Commercial Code, a legal entity under public law or separate funds under public law. The same applies if the customer does not have any other place of jurisdiction in Germany or has moved their domicile abroad after concluding the contract. We are entitled to also file a lawsuit against the customer in other authorised places of jurisdiction.”

Kermi takes the protection of personal data very seriously. We would like you to know when we save what data and how we use it. As a private-law company, we are subject to the provision of the Federal Data Protection Act (BDSG). We have taken technical and organisational measures which ensure that the data protection provisions are heeded by both us and external service providers.
Personal data
Personal data is information which can be used to ascertain your identity. This includes information such as your real name, address, postal address, telephone number, e-mail and web address. Information which is not directly associated with your real identity (such as favoured websites or number of users on a site) is not included.As a general rule, you can use our web pages (public area) without revealing your identity.
If you register for one of our personalised services (Kermi partner area), i.e. you are interested in specialist SHC information, order a product (e.g. printed documents etc.) or subscribe to the eNewsletter, we will ask you for your name and for other personal information. You can freely decide whether you want to make use of this service. We will save your data on especially protected servers. Access is only possible by a few, especially authorised people entrusted with technical, commercial or editorial maintenance of the servers.In association with your access, data which allows identification is stored for security purposes. Statistical evaluation of the datasets for company-internal purposes is always reserved.
Passing personal information onto third parties
We only use your personal information within Kermi GmbH as well as in our associated companies. We will not pass it on to third parties without your express permission. If, within the context of processing order data, such data is passed on to service providers, then they are bound by the BDSG, other legal obligations and contractually bound to Kermi GmbH. Where we are legally required to do so by law or court order, we will pass your data onto relevant authorities entitled to receive such information.
Right of withdrawal
If you have entrusted us with personal data, you can delete it again at any time. You can cancel your access at any time under “Edit or cancel registration”.Your data will be deleted.
Use of Cookies
We use “Cookies” (small files with configuration information) according to the stipulations of the German circulation research organisation – Informationsgemeinschaft zur Feststellung der Verbreitung von Werbeträgern e. V. (IVW). They help make it easier for you to use the Kermi web pages and determine the use frequency and number of users on our website. In some areas of our internet service we use cookies to realise user functions. It is also possible to use our internet service without cookies. Most browsers are set so that they automatically accept cookies. However, you can deactivate cookies being saved or set your browser so that it informs you as soon as cookies are sent.
Private individuals and children
Private individual and people under the age of 18 should not send us any personal data. The Kermi partner area is restricted to specialist companies and their employees from the sanitary, heating and air-conditioning sector. We do not ask for any personal data from private individuals and children, we do not collect it and do not pass it onto third parties.
